Welcome and Thank you for your purchase and for reading these Terms of Use.

These digital files are the product of Jodiann Cates aka Jodiann’s Sky Pie and are protected by international copyright law. You have been granted a limited use license to be outlined further herein. NO transfer of ownership is granted NOR implied. These Terms of Use replace all previous versions and may change anytime with or without notice. Downloading digital files constitutes you agree with all these terms. Failure to read these terms is not a release. All your questions are welcome at jojo[at]jodianncates[dot]com. Please ask about whatever you don’t understand.

First off, DO NOT redistribute these raw digital downloads to your friends, or on any groups, or on disc, or on any torrent, or on any file sharing service, whether you paid or were given it as a freebie. Your purchase of Jodiann’s Sky Pie Commercial Use products include Personal Use Privileges. Let’s start there.

What is allowed for Personal Use:

1. Use in your own original scrapbooking layout/artwork to print, to publish, to display your work in any media, galleries, forums, or on blogs/websites. Credit is NOT required. BUT whenever I find credit voluntarily given ( Product Name, by Jodiann’s Sky Pie) a $10 coupon will be awarded to the artist.  Thank you!

2. Use to adorn your own personal Blog or Website as long as the display is in .jpg/.png form and not more than 72dpi. BUT whenever I find credit voluntarily given ( Product Name, by Jodiann’s Sky Pie) a $10 coupon will be awarded to the artist.  Thank you!

3. Use in Scrap For Hire ( paid) /Scrap For Others ( free) projects so long as the final result is delivered in a flattened .jpg/.png form and your client/customer agrees to not sell your creations using my products.

What is NOT allowed for Personal Use:

3. DO NOT sell or give away PNGs, JPGs, ABRs, SVGs aka Cutting Files, CSH, PSDs, TUBs, digital stamps, etc. of my products – in original format or altered.

4. DO NOT use my PERSONAL USE ONLY designs to adorn Blogs or Websites for OTHERS be it with or without compensation.

What is allowed for Commercial Use:

1. Use Jodiann’s Sky Pie Commercial Use Products to design your own freebies, digital scrapbook kit, papers, elements, word art, alphas and related kit items to sell to your customers for

a. their personal use.

b. their scrap for hire and scrap for others projects. As long as the customer agrees their final result will be delivered in a flattened .jpg/.png form and not to sell their creations for commercial use as well as does not make them available on any print on demand sites.

c. their personal printing, be it at home, or by professional print shop for hire.

2. Use UP TO 30% of Jodiann’s Sky Pie Commercial Use Products in a single digital kit/product creation.

3. Digital Alpha/WordArt creations enjoy extended use UP TO 60%.

4. Use UP TO 30% of Jodiann’s Sky Pie Commercial Use Products to make and sell the following:

- printed kits for retail stores.

- commercial website/blog designs.

- commercial logos for yourself or others.

- pre-made logos/branding concepts.

- pre-made web/blog templates.

- digital/rubber stamps

- cards, gift tags, invites, announcements.

- lessons, plans, class, work sheets and other teaching materials.

- other printed items in any form from raw craft materials like paper and textiles, to premade products like but not limited to mugs, canisters, framed and unframed prints. This includes sales on print on demand sites like but not limited to Cafe Press, Snapfish, Zazzle, Minted.

Readable credit is NOT required. BUT whenever I find credit voluntarily given ( Product Name, by Jodiann’s Sky Pie) a $10 coupon will be awarded to the artist.  Thank you!

What is NOT allowed for Commercial Use:

1. DO NOT sell or give away Jodiann’s Sky Pie products in their original form. This means you must use my products to create/design with. Make them your own in some way. Such as use one of my styles, textures, overlays etc. on your own creation, or vise-versa.
2. DO NOT build like or competing designs with Jodiann’s Sky Pie PU or CU products using Jodiann’s Sky Pie CU Products.

Examples:

a. Layer Styles in CANNOT be used to make Layer Styles out even if they are for PU by your customers.

b. Overlays in CANNOT be used to make Overlays out even if they are for PU by your customers. See where I am going with this?

c. Your Kit/product using a CU product from Jodiann’s Sky Pie CANNOT be too similar in name, or design style, or color palette to one produced by Jodiann’s Sky Pie where a customer might confuse the design origins of either of our kits/products. If a customer of yours or mine contacts me with a complaint that my item too closely resembles yours, you will be required to pull your item and rework it if you want to offer it for sale once more.

3. DO NOT sell or give away PNGs, JPGs, ABRs, SVGs aka Cutting Files, CSH, PSDs, TUBs, digital stamps, etc. of my products – in original format or altered.

4. DO NOT allow YOUR customers to turn over any designs made using any portion of Jodiann’s Sky Pie Products to any print company for any reason other than their own Personal Use. Allowed Commercial Use #3 above does NOT apply to your customers.
